These Terms and Conditions (Terms) govern the Train and Gain with Jack Jenkins promotion (Promotion) conducted by Dabble Sports Pty Ltd (ABN 26 641 982 425) (Promoter). By entering the Promotion, each entrant agrees to be bound by these Terms. The Terms consist of the Schedule and General Conditions of Entry set out below.

SCHEDULE: Key Promotion Details

These General Conditions must be read together with the Schedule (together the Terms). The Schedule prevails to the extent of any inconsistency.

1. Participation in the Competition constitutes acceptance of the Terms.  

2. Any capitalised terms used in these Terms have the meaning given in the Schedule, except where stated otherwise. 

3. These Terms may be amended or replaced by the Promoter in its discretion at any time.  

4. This promotion is open to individuals who reside in the Eligible States and meet the Entry Conditions.  

5. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or and of any associated agencies or organisations are ineligible to enter. “Immediate families” means spouse, parent, child or sibling (whether natural, adopted or step), whether or not they live in the same household.   

6. Entries must be submitted in accordance with the Entry Procedure during the Promotion Period. Once submitted, entries cannot be altered or deleted.  

7. Entries that do not meet the entry requirements, are incomplete, or are submitted using automated means will be invalid.

8. The Promoter may, in its discretion, declare any entry invalid or disqualify any entrant who breaches these Terms or behaves fraudulently, misleadingly, or inappropriately.

9. The Prize Draw will be conducted in accordance with the Draw Details in the Schedule.

10. The Prize will be awarded to the persons associated with the drawn Valid Entry (the Winner).

11. The Winner will be notified as specified in the Schedule and will be required to verify their identity including their proof of age and residency and must also provide contact mobile number and email address.

12. The Promoter may publish the Winner’s name and / or social-media handle on its website, in App and social media channels.

13. The Winner must claim the Prize by the Prize Claim Date.  

14. If the Prize is not accepted or claimed by the Prize Claim Date, the Prize is forfeited by that Winner and the Promoter may conduct an Unclaimed Prize Draw as set out in the Schedule, subject to any directions given by any relevant authority.

15. The Winner is responsible for making all personal arrangements within the timeframes set out, to ensure that they and their guest can participate in the Prize.

16. The Winner must ensure that they and their guest work cooperatively with the Promoter around the participation in the Prize, including the making of bookings and reservations.

17. The Prize Details are set out in the Schedule and subject to any restrictions specified in the Schedule.

18. Prize Period means the period during which the Prize must be utilised, including any reasonable travel times before and after the Prize experience, as specified by the Promoter.

19. Any vouchers included in the Prize are only valid during the period that the Prize Period and are subject to any terms and conditions imposed by the relevant third-party providers. Once awarded, the Promoter will not be liable for any voucher that is expired, lost, stolen, forged, damaged or tampered with in any way.  

20. If a Prize includes tickets, the tickets are only valid for the date(s) or period(s) specified on the tickets or by the ticket issuer and will be subject to any terms and conditions imposed by the ticket issuer. Once awarded, the Promoter will not be liable for any ticket that is expired, lost, stolen, forged, damaged or tampered with in any way.  

21. The Promoter reserves the right to appoint a chaperone to accompany the Winner. The Winner agrees to a chaperone being present with them for the duration of the Prize Period and agrees to comply with any reasonable directions or guidelines notified to them by the Promoter or their chaperone. 

22. If the Prize includes travel, the Winner is responsible for ensure that all elements of the Prize are booked and completed as required by the Promoter and/or by the supplier of the Prize elements (including elements relating to any guest).

23. If the Prize is event based, all travel provided as part of the Prize must be taken during the Prize Period to coincide with the event.

24. The Prize is subject to booking and availability and is subject to any terms and conditions imposed by the relevant third-party providers. The Winner is responsible for ensuring that they and their guest abide at all times to any such terms and conditions, failure to do so may result in all or part of the Prize being revoked by the Promoter.

25. All costs associated with the Prize which are not expressly stated in the Schedule to be included (such as additional spending money, meals, taxes, flights, accommodation, insurance, luggage costs and all other ancillary costs), are the responsibility of the Winner and/or their guest.

26. The Winner and their guest are responsible for ensuring they have all necessary travel insurance and documents required for the travel.

27. Any alterations or extensions to confirmed any prize elements must be approved in advance by the Promoter (at its sole discretion) and will be at the expense of the Winner.

28. If the winner resides within 300km from Melbourne CBD, the winner and their guest will not be provided with flights.

29. Ground transfers will be made available in the form of ride-share vouchers based on the Promoter’s assessment of the travel requirements of the Winner and their guest and will be capped at $100 per journey.

30. The Promoter is not responsible for the cancellation, delay or rescheduling of any travel element of a Prize and any ensuing costs incurred by the Winner or their guest as a result (including accommodation costs) will be the responsibility of the Winner and/or their guest.

31. The Winner is responsible for ensuring that they and their guest are fit to travel as and when required.

32. The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.

33. The Promoter may, at its sole discretion, declare any or all entries made by an entrant invalid, and prohibit further participation by an entrant in this Promotion, if the entrant or their guest:  

a. fails to verify their personal details and/or eligibility to enter the Promotion to the Promoter's satisfaction;  

b. tampers with or benefits from any tampering with the entry process or the operation of the Promotion;  

c. submits an entry which in the Promoter's opinion is not in accordance with these Terms;  

d. acts in a disruptive manner or with the intent to annoy, abuse, threaten or harass any other person; or engages in conduct regarding the Promotion which in the Promoter’s opinion is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.   

34. The value of the Prize is accurate as at the time of preparation of this material. The Promoter accepts no responsibility for any variation in the value of a Prize after that date.

35. If a prize is unavailable for any reason, the Promoter may substitute it for an alternative at its own discretion.

36. If a Winner and/or their guest does not take an element of a Prize at the time stipulated by the Promoter, then that element of the prize will be forfeited and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. The Promoter accepts no other liability or responsibility for any loss incurred by a Winner or any other party, if any Prize (or any part of a Prize) is unavailable for any reason.  

37. If requested by the Promoter, the Winners and their Guests must sign an indemnity and exclusion of liability form provided by the Promoter, in favour of the Promoter, before they participate in any activity associated with the Prize. If such form is not signed within the time specified by the Promoter, the Prize may be revoked by the Promoter.

38. Where an entry is declared invalid, or a Prize is revoked, prior to the Prize Claim Date, the Promoter may determine a new Winner in accordance with the Unclaimed Prize Draw.  

39. If requested by the Promoter, the Winner must participate in all promotional activity (such as publicity and photography) surrounding this Promotion or their winning of the Prize, free of charge, and they consent to the Promoter and its associated companies and agencies using their name and image in promotional material.  

40. If for any reason any aspect of this Promotion does not run, or is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval of the relevant authorities in the Relevant State(s), if required.  

41. The Promoter’s decisions in connection with the Promotion are final and no correspondence will be entered into.  

42. Entrants acknowledge that there may be inherent risks in some aspects of the Prize and that participation may involve exposure to, or participating in, dangerous activities. By entering this Promotion, entrants accept that risk for themselves and their guest.

43. The Promoter, its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion, accepting or participating in a Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).  

44. The Promoter and its associated agencies and companies will not be liable for any damage or delay in the awarding of the Prize.  

45. The Promoter may at its absolute discretion prohibit an entrant’s participation in this Promotion, cancel or suspend the Prize, or cease to provide any Prize component to a Winner and/or their guest; if the entrant or Winner and/or their guest is (in the Promoter’s opinion) under the influence of alcohol or drugs, behaves aggressively or disruptively, or behaves in a manner which may diminish the good name and reputation of the Promoter or its products and brands, or is contrary to law or is otherwise inappropriate.  

46. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.  

47. The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose entrants’ personal information to companies and agencies connected with this Promotion and to relevant authorities in the Relevant States, and the Winner’s name may be published in accordance with these Terms and as required under relevant legislation.

48. The Promoter’s Privacy Policy is available on the Promoter’s website www.dabble.com.au.  

49. If the Competition is conducted via the Facebook or Instagram Platforms:

a. Entrants acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram.

b. Entrants acknowledge that any information they provide in connection with the Competition is provided to the Promoter and not to Facebook or Instagram.

c. Any questions, comments or complaints regarding the Competition should be directed to the Promoter, not to Facebook or Instagram.

d. Entrants release Facebook and Instagram, and their associated companies from all liability arising in respect of the Competition.
